By using this Website, contacting us, requesting any Service, or engaging Business Fastup for a Project, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
1. Use of the Website
You may use this Website only for Lawful Purposes and to obtain information about Business Fastup’s Services.
You agree that you will not:
Use the Website for any Unlawful, Fraudulent, or Unauthorized Purpose.
Attempt to obtain Unauthorized Access to the Website or its Systems.
Interfere with the Security, Functionality, or Operation of the Website.
Upload or transmit any Virus, Malware, Malicious Code, or other Harmful Material.
Copy, Reproduce, Modify, or Misuse Website Content without appropriate Permission.

The Services, Features, Scope of Work, Deliverables, Timeline, Charges, Revisions, and other Requirements for a particular Project will depend on the Terms mutually agreed between the Client and Business Fastup.
Service information available on this Website is provided for general Informational Purposes and does not by itself constitute a Binding Offer.
3. Project Scope and Client Requirements
Before starting a Project, the Project Requirements, Scope of Work, Deliverables, Charges, Estimated Timeline, and other applicable Terms may be communicated to the Client through an appropriate Communication Method.
The Client must provide accurate and sufficient:
Information
Content
Images
Documents
Logo
Login Details
Access Credentials
Other required Materials
within the required time.
Any delay in providing Information, Content, Approval, Access, or other required Materials may affect the Project Timeline.
Any Work outside the agreed Scope of Work may be treated as Additional Work and may be subject to Additional Charges.
4. Payment Terms
Business Fastup does not provide any Online Payment Gateway or Online Checkout Facility on its Website.
Service Charges and Payment Details may be communicated directly to the Client before or during the Project.
Payment will be made between the Client and Business Fastup through a mutually agreed Payment Method.
Depending on the Project requirements and mutual agreement, Payment may be made through:
Advance Payment
Milestone-based Payment
Payment after Completion/Delivery
Where an Advance Payment is applicable, Work may begin after confirmation of receipt of the Advance Payment.
Advance Payment may be used towards Project Planning, Development Work, Working Time, Resources, Third-Party Services, and other Project-related Expenses.
If the Client cancels the Project, any applicable Refund may be determined based on Completed Work, Project Stage, Third-Party Expenses, Non-Recoverable Expenses, Agreed Terms, and Applicable Law.
5. Additional Work and Changes
The Initial Project Scope will be based on the agreed Requirements and Deliverables.
Any Work not included in the Initial Scope, including:
New Features
Additional Pages
New Integrations
API Integrations
Design Changes
New Functionality
Content Work
Development Work
Other Additional Work
may be subject to Additional Charges and Additional Time.
Where reasonably possible, the Client will be informed before significant Additional Work is started.
6. Project Timeline and Delivery
The Estimated Project Timeline depends on the Client providing the following on time:

Access
Feedback
Other required Materials
The Project Timeline may be affected by:
Client Delays
Approval Delays
Delays in Content or Materials
Domain or Hosting Issues
Third-Party Services
API or Software Limitations
Technical Problems
Changes made by the Client
Other circumstances beyond the reasonable control of Business Fastup
Unless a specific Delivery Date has been agreed in a separate Written Agreement, the Estimated Timeline is not a Guaranteed Delivery Date.
7. Revisions and Approval
The Number and Scope of Revisions included in a Project will depend on the Project Terms agreed between the Client and Business Fastup.
The Client should Review the delivered Work within a reasonable period and provide the required Feedback.
Additional Changes or Revisions outside the agreed Scope after the Client has Approved the Design, Content, or Website may be treated as Additional Work.
8. Cancellation and Refund
If the Client wishes to cancel a Project, the Client should inform Business Fastup as soon as reasonably possible.
In the event of Cancellation, any applicable Refund may be determined based on:
Completed Work
Current Project Stage
Advance Payment
Third-Party Expenses
Non-Recoverable Expenses
Agreed Terms
Applicable Law
To the extent permitted by Applicable Law, amounts relating to Completed Work and incurred or non-recoverable expenses may be Non-Refundable.
Any applicable Refund may be Processed through the mutually applicable Payment Method within a reasonable period.
Nothing in these Terms is intended to remove or restrict any Rights or Remedies of the Client that cannot legally be excluded or restricted under Applicable Law.
9. Third-Party Services and Platforms
A Project may require the use of Third-Party Services, Platforms, APIs, Plugins, Software, or External Services.

Policies
Limitations
Renewal Conditions
Usage Limits
Security Requirements
Service Conditions
Business Fastup does not control changes made by Third-Party Providers to their Pricing, Availability, Functionality, APIs, Security, Policies, Suspension, Restrictions, or Service Continuity.
Business Fastup will not be responsible, to the extent permitted by Applicable Law, for Problems resulting from Third-Party Changes, Limitations, Downtime, Suspension, or Failure where such issues are beyond the reasonable control of Business Fastup.
Applicable Third-Party Charges will be paid separately by the Client.
10. Domain and Hosting
Domain Name and Web Hosting Costs are not included in Website Development Charges.
The Client should purchase the Domain Name and Web Hosting separately, in the Client’s own name and at the Client’s own expense. The Client is responsible for the Purchase, Payment, Renewal, Expiry, and Account Management of the Domain and Hosting.
If Business Fastup purchases or provides a Domain Name or Web Hosting at the Client’s Request, the applicable Cost will be separate from the Website Development Charges.
Such Cost may vary depending on the Domain/Hosting Provider Company, Hosting Plan, Domain Category, Hosting Category, Duration, and available Features.
Where applicable, Third-Party Charges related to Domain and Hosting will be charged separately to the Client.
Business Fastup may Setup, Configure, and Deploy the agreed Website on the Domain and Hosting provided by the Client.
If the Domain or Hosting is not Renewed on time, Payment is not made, or the Service Provider Suspends, Terminates, or Restricts the Service, Business Fastup will not be responsible for any resulting impact on Website Availability or Functionality.
11. Website Authenticity and Permitted Use
Business Fastup provides Genuine and Legitimate Website Development Services to Clients.
Business Fastup does not knowingly Create or Develop a Website for a Client where the Website is intended for a Fake, Fraudulent, Misleading, Impersonation, or Illegal Purpose.
Business Fastup reserves the right to Reject, Suspend, or Cancel any Website Development Request where there is reasonable concern that the Website may be used to misrepresent a person, Business, Organization, Brand, or Service, Mislead Users, commit Fraud, or facilitate any Illegal Activity.
12. Client-Provided Information and Materials
The Client is responsible for all Business Information, Content, Images, Documents, Logos, Trademarks, and other Materials provided for the Website.
The Client must ensure that all Information and Materials provided by the Client:
Are accurate, current, and complete to the extent reasonably required;
Are used for Lawful and Legitimate Purposes;
Do not infringe any Third Party’s Copyright, Trademark, Privacy, Publicity, or other Legal Rights; and
Are not related to any Fake, Fraudulent, Misleading, or Illegal Activity.
The Client will be responsible for any Claim, Complaint, Legal Notice, Dispute, Loss, Damage, or Legal Action made by a Third Party in relation to Information or Materials provided by the Client.
Business Fastup will not be responsible for such matters unless the relevant issue was caused by the intentional wrongdoing or deliberate misconduct of Business Fastup.
13. Login Details, Security and Technical Support
After the agreed Work has been completed and the Website has been Delivered/Handed Over, the required Login Details and Access Credentials may be provided to the Client.
After receiving the Login Details, the Client is responsible for their Security, Confidentiality, Password Protection, Account Access, and Management.
The Client should keep Login Details secure and should not share them with any Unauthorized Person.
After Website Handover, Business Fastup will not be responsible for any Problem, Error, Data Loss, Security Issue, or change in Website Functionality resulting from Changes, Updates, Plugin/Theme Installation, Configuration Changes, Content Changes, Security Settings, Password Changes, or other Modifications made by the Client or any person Authorized by the Client, unless Business Fastup has separately accepted responsibility for such Work.
1 Year Free Technical Support
The Client will receive 1 Year Free Technical Support with the Website Development Service.
This Support is limited to general Technical Issues, Basic Troubleshooting, and Technical Assistance related to the Website.
1 Year Free Technical Support does not include the following unless separately agreed by Business Fastup:
New Feature Development
Major Design Changes
Additional Pages
New API Integration
Major Functionality Changes
Content Creation or Major Content Updates
Third-Party Service Charges
Reversing or Fixing Changes made by the Client
Other Additional Development Work
The 1 Year Free Technical Support period will begin from the Website Delivery/Handover Date.
After the completion of one year, Technical Support, Maintenance, or Website Management Services may be provided subject to Additional Charges.
14. Intellectual Property
Ownership and Usage Rights relating to Website Content, Design, Graphics, Code, or other Materials specifically created for the Client will depend on the Payment, Scope, and mutually agreed Terms of the Project.
Business Fastup may retain its Rights in pre-existing:
Tools
Templates
Frameworks
Reusable Components
General Techniques
Know-how
Development Methods
Resources
and other Materials that were not exclusively created for the Client.
Business Fastup’s own Logo, Branding, Website Content, Graphics, and other Proprietary Materials must not be Copied, Reproduced, Modified, Resold, or Commercially Used without Permission, except where permitted by Applicable Law.
15. Website Availability
Business Fastup may make Reasonable Efforts to keep the Website Functional and Available according to the agreed Requirements.
However, Uninterrupted, Error-Free, or Continuous Website Availability is not Guaranteed.
Website Availability may be affected by Maintenance, Software Updates, Security Issues, Hosting Problems, Technical Failures, Third-Party Services, Internet Connectivity, or other External Circumstances.
16. External Links
The Website or Project may contain Links to Third-Party Websites, Services, or Platforms for Convenience or Information.
Business Fastup is not responsible for the Content, Availability, Security, Privacy Practices, Policies, or Services of Third-Party Websites.
Use of any Third-Party Website or Service is subject to the respective Provider’s own Terms, Policies, and Conditions.
17. Limitation of Liability
To the extent permitted by Applicable Law, Business Fastup will not be responsible for any Indirect, Incidental, Special, or Consequential Loss or Damage arising from the use of, or inability to use, any Website or Service.
Business Fastup will also not be responsible for Losses or Problems resulting from circumstances beyond its reasonable control, including:

Nothing in this Section is intended to Exclude or Limit any Liability that cannot legally be Excluded or Limited under Applicable Law.
18. No Guarantee
Business Fastup will make Reasonable Efforts to provide Services according to the agreed Scope of Work, Project Requirements, and mutually agreed Terms.
However, Business Fastup does not Guarantee any specific or fixed Business Result, Financial Result, Customer Response, Traffic, Leads, Enquiries, Sales, Revenue, Ranking, Conversion, or Business Growth.
The Results of Website Development, SEO, API Integration, and other Digital Services may depend on various Factors, including:
Market Conditions
Competition
Business Decisions made by the Client
Pricing
Content
Customer Behaviour
Search Engine Algorithms
Third-Party Platforms
Changes made to the Website or Service
Other External Factors
Therefore, no specific Result or Business Outcome will be considered Guaranteed.
19. Privacy
Personal Information handled in connection with the Business Fastup Website and Services may be handled according to our Privacy Policy.
The Privacy Policy may provide information regarding the Collection, Use, Storage, Retention, Cookies, and other applicable Privacy Practices relating to Personal Information.
Clients are advised to review the Privacy Policy before using the Website.
